Selling

Capital Property Conveyancing will provide the following service when selling a property:-

  • Completing all relevant property searches and certificates (including Title Search, Registered Plan, Land Information Certificate, Water Information Certificate, Planning and Bushfire Certificate, SRO Land Tax Certificate, VicRoads Certificate, EPA Certificate and  Owners Corporation Certificate) to ensure all relevant information pertaining to the property for sale is disclosed accordingly- all Victorian property cannot be sold without a Vendor Statement (Section 32);

  • Preparation of the Contract of Sale and Vendor’s Statement (Section 32) and issuing these documents to the Real Estate Agent for both private sale and Auction;

  • Liaising with the Mortgagee on Title to ensure the bank prepares the appropriate discharge of mortgage once the property is sold;

  • Preparation of Section 27 Statement (early release of deposit) and obtaining details from the Mortgagee on Title to complete Section 27 Statement and forwarding to the Purchaser’s representative to sign if requested/required);

  • Review of the Transfer of Land Land Titles Office document and electronically signed on your behalf;

  • Preparation of Capital Gains Withholding Statement and GST withholding Statement for the Purchaser (if applicable to the property);

  • Review Statement of Adjustments and Settlement Statements on your behalf in preparation for settlement;

  • Book electronic settlement on PEXA with the relevant parties including Mortgagee on Title;

  • Action all steps necessary to complete Settlement on your behalf;

  • Notify relevant authorities and issue the Notice of Disposition confirming change of ownership of the property.
